Pimentel III as senator

His term as senator began not when he was sworn in at Mati, but when he was sworn in by Enrile in a Senate session. –HTD 04:57, 16 March 2013 (UTC)[reply]


I think his term effectively began after he was sworn in at Mati. I consider his swearing in at the Senate three days later as a "repeat" of his oath of office. This is currently being practiced in the House of Representatives whenever a new Congress convenes in July. By virtue of the Constitution, their terms formally begin on June 30, even if the Congress has not yet began its session. CaviteK1NGP1N (talk) 05:34, 16 March 2013 (UTC)[reply]

It's a good thing you brought up the House of Representatives. There's this case of Celestino Martinez III and Benhur Salimbangon in Cebu. The latter was ousted by the HRET in favor of the former. Nograles already had a "private oath-taking" for Martinez in his office (akin to Pimentel's oath-taking in Mati) but that was invalid because he had to be sworn in at the plenary.
I'd guess the June 30 rule is only valid for members of Congress elected at least during Election Day, or at most, before either chamber convenes in July. Also, in the member roster section in the House website, the congressmen who assumed office after the session convened (mostly via special elections), reckoned the start of their terms when they took the oath of office at the plenary. –HTD 05:43, 16 March 2013 (UTC)[reply]
